Electronic Record Recognition (Nepal Legal Framework)

This legal document is an electronic record recognized under Nepal's Electronic Transactions Act, 2063 (2008), which governs the legal validity of electronic records and signatures. A computer system generates this electronic record and does not require any physical or digital signature.

This privacy policy applies to all users and subscribers of our websites. By using this website or completing the contact/registration process offline, you agree and acknowledge that you have carefully read this privacy policy and accepted this agreement.

We value your privacy and believe you must understand how we, Quark Infotech ("Quark Infotech," "we," "us," or "our"), collect personal data from you and from third parties. We aim to inform you about your rights as a data subject or consumer.

Our Data Protection Commitment

At Quark Infotech, we prioritize the security and protection of personal information. Our data protection practices are designed to comply with Nepal's Individual Privacy Act, 2075 (2018) and the Individual Privacy Regulation, 2077 (2020), and — where we work with international clients or process data of individuals outside Nepal — we align our practices with globally recognized standards such as the GDPR, to the extent applicable.

Data Protection Overview

Nepal's Individual Privacy Act, 2075 (2018) ("Privacy Act") gives effect to the constitutional right to privacy under Article 28 of the Constitution of Nepal, and governs how personal information is collected, stored, used, and protected. As a company that processes data on behalf of clients both in Nepal and internationally, Quark Infotech follows practices consistent with the Privacy Act and Regulation, including:

  • Individuals may exercise rights over their personal information, including access, correction, and objection to certain uses.
  • We collect and use personal data only with the individual's knowledge and, where required, consent — informing them of the purpose, method, and retention period of collection.
  • We implement technical and organizational measures to secure personal data, including encryption and system safeguards, against unauthorized access, use, alteration, or disclosure.
  • We take reasonable steps to prevent unauthorized disclosure or misuse of personal data and to report and investigate any breach.
  • We do not disclose or transfer personal data to third parties without the individual's consent, except where legally required.
  • Staff involved in handling personal information are made aware of their responsibilities under applicable privacy law.
  • You can request access to, correction of, or deletion of your personal data, and Quark Infotech will respond to such requests in line with the Privacy Act.

Our Privacy Commitment

We collect information to provide better services to our users, existing clients, and potential new clients — from basic details like your IP address, which tells us your approximate location, to more specific details like the referral URL that tells us which website sent you to us.

Strict No Data Selling Guarantee

Quark Infotech has never sold your information to any third party for advertising or monetary purposes, or to show you other people's ads and promotions — and we never will. This policy explains what information we collect from you, what we do with it, who can access it, and what choices you have.

1) Information Quark Infotech Collects and Controls

We only collect the information we need to provide services to you. Some of that information you give us proactively when you contact us via email, contact forms, or lead-generation forms to ask about our services or make a purchase. We store your name and contact information, such as phone number, social profiles, address, and project-related information.

When you visit one of our websites or use our services, we automatically log some basic information, such as how you arrived at the site, where you navigated within it, your approximate location, and the features and settings you use. We use this information to improve our websites and services.

Sometimes we receive information indirectly — for example, if you learn about our services through a referral program or reselling partner, or sign in to one of our products through an authentication provider such as LinkedIn, Google, or Facebook. We'll use that information to complete your request. We'll also access your interactions and profile information if you engage with our brand on social media (liking, commenting, retweeting, mentioning, or following us). We may retain that information even if you later remove it from the social media site.

What We Do With Your Information

We use your information to provide the services you've requested and to create and maintain your account. We also use it to communicate with you about services you're currently using, customer support requests, new services you may be interested in, opportunities to give us feedback, and policy updates. We analyze the information we collect to understand user needs and improve our websites and services.

Under the Privacy Act, we collect and use personal information only for a stated, legitimate purpose and, in most cases, with your knowledge or consent. Where consent is not the basis for processing (for example, a legal requirement), we rely on that legal basis instead.

You can decline certain uses of your information either by not providing it in the first place or by opting out later. You can also disable cookies in your browser, though certain website features may not work properly as a result.

We limit the use of third-party cookies across Quark Infotech websites and restrict access to your personal information to employees and vendors who have a legitimate need to use it, consistent with the Privacy Act's requirement that only an authorized person handle personal data.

We keep your personal information only as long as required for the purposes described in this Privacy Policy. When we no longer have a legitimate need to process your information, we delete, anonymize, or isolate it, as appropriate.

2) Information that Quark Infotech Processes on Your Behalf

If you use Quark Infotech's services to handle other people's data — such as information about your customers or employees — you entrust that data to us for processing on your behalf.

As a service provider, we may process your customers', employees', and vendors' data as part of project development. You own your service data. We protect it, limit access to it, and process it only according to your instructions. You may access it, share it through third-party integrations, or request that we export or delete it.

We retain the data for as long as you use Quark Infotech services. After your contract ends, we may keep a backup for a limited period. Your data will be deleted from our development and backup servers upon your request.

If you believe someone has entrusted your information to us for processing (for example, your employer or a company whose services you use) and you wish to exercise rights over that data, please contact that party directly; we will work with them to fulfill your request.

3) General Terms & Disclosures

There are limits to the privacy commitments we can make. Where necessary, we will disclose personal information to comply with a legal obligation, prevent fraud, enforce an agreement, or protect our users' safety. We do not currently honor Do Not Track signals from web browsers; if a universal standard for handling them emerges, we will adopt it.

Third-party websites and social media widgets have their own separate privacy policies. Always review the relevant privacy policy before sharing personal information with third parties.

You can contact us at any time with questions about our privacy practices, to flag a concern about data collected from a minor, or to request removal of your personal information from our blogs or forums.

We will notify you of any major changes to this privacy policy or, in the unlikely event that we decide to sell our services, of that change.

1) Information We May Collect About You

Information you give us: When you contact us or get in touch, you may be asked to complete a registration form or provide details over the phone — for example, when requesting a quote for a development service, registering for an event, or subscribing to our mailing list. This information may include your name, address, email address, phone number, and other relevant details. By emailing us, you agree that we may retain the content of your messages along with your email address. You also agree that we may use your email address and phone number to send promotional or informational messages.

Information we collect about you: We collect information from correspondence between you and us, whether through contact forms, email, or phone calls. For service promotions and any events we host or participate in, we may collect information about your location and engagement with the event. We collect information about your visits to our website, including your IP address, geographical location, device information, browser type, referral source, length of visit, operating system, pages viewed, and similar data. This information may be collected by a third-party analytics provider on our behalf, and/or through cookies and pixels (including in emails, to track delivery and open rates). We use third-party analytics services for detailed analysis, and we have limited control over how those services handle data; you acknowledge that we are not responsible for privacy practices of those third-party analytics providers beyond our reasonable control.

Information we receive from third parties: We may receive information about you from third parties we work with to deliver our services, or where you have consented to a third party sharing your information with us.

Depending on our relationship with you, we may use your information for the following purposes. Before you submit data to us, we'll provide you with more specific information, where relevant, about how we intend to use it.

Our infrastructure is secured behind firewalls, with data stored on secured on-premises and cloud servers, supplemented by additional layers of data protection appropriate to the sensitivity of the information involved. Quark Infotech maintains a systematic, ongoing approach to information security that safeguards the confidentiality, integrity, and availability of company and customer information.

8) Your Rights Regarding Your Personal Data

Consistent with the Individual Privacy Act, 2075 (2018), you have the right to:

  • Request a copy of the personal data we hold about you by writing to us.
  • Ask us to correct any inaccurate information we hold about you.
  • Ask us to stop processing your data or withdraw consent, where consent is our basis for processing.
  • Request that we delete your personal data, subject to any retention obligations under applicable law.

Disclosures in compliance with legal obligations: We may be required by law to preserve or disclose your personal information and service data to comply with applicable law, regulation, legal process, or governmental request.

Enforcement of our rights:We may disclose personal information or service data to a third party if we believe it's necessary to prevent fraud, investigate suspected illegal activity, enforce our agreements or policies, or protect the safety of our users.

Business transfers: We do not intend to sell our business. If we are acquired or merged, we will ensure the acquiring entity is legally bound to honor our commitments to you, and we will notify you by email or via a prominent website notice of any change in ownership affecting your personal information.

Notification of changes:We may update this Privacy Policy at any time by posting a service announcement or emailing your primary address. Significant changes affecting your rights will come with at least 30 days' advance notice by email. Continued use of our services after changes take effect constitutes your agreement to the updated policy.

Refund Policy

Quark Infotech aims to support its customers as fully as possible and maintains a considerate cancellation policy. As we provide services rather than tangible products, our offerings cannot be "returned" in the traditional sense once delivered.

  • All projects are undertaken under defined milestones that set the direction and roadmap for the project.
  • Web design, development, and application work is carried out only after a complete scope document is created, ensuring shared understanding and reducing the likelihood of cancellations or disputes.
  • Because work is required to complete each project milestone, refunds are not available for work already completed.
  • If a project is terminated by mutual agreement, the client retains all work completed to date, and any funds paid for further, undelivered development will be returned.
  • If a client chooses to work with a different provider within 48 hours of project initiation, Quark Infotech will refund the amount paid to date for that project.
  • Special-occasion or promotional offers from our marketing team are non-cancellable, as these are limited-time offers.
  • Time & Material (T&M) based services and Hire-Dedicated-Developer engagements are non-refundable.

Cancellation Policy

All cancellation requests must be submitted in writing (by email) to Quark Infotech's Project Management Office (PMO). Requests are not considered valid until confirmed by our PMO.

  • We take a minimum of two weeks to process cancellation requests.
  • Cancellation terms are governed by the service level agreement (SLA) in place for your project.
  • Projects that have entered beta delivery cannot be cancelled.
  • If a project is cancelled by mutual agreement, you are responsible for payment for effort invested up to the date of cancellation.
  • Source code, design files, or other project materials will not be delivered until outstanding payment is settled.

Delivery Policy

As a service provider, we don't ship tangible goods, so there's no risk of a lost or misplaced shipment. Our deliverables take the form of design files, software code, and compiled applications, delivered electronically via our collaboration tools or email. Please retain your own copy of delivered files on your server or storage media. Within 30 days of delivery, Quark Infotech can re-send electronic files upon request; after that period, we are not obligated to do so.

Reasonable Security Practices & Choice

We have implemented security practices consistent with the Individual Privacy Act, 2075 (2018) and Individual Privacy Regulation, 2077 (2020), which require that personal information be collected, stored, and processed only by an authorized person, with appropriate safeguards against unauthorized access, use, alteration, disclosure, or destruction.

We apply internationally accepted standards of managerial, technical, operational, and physical security to protect your personally identifiable information. Data is stored behind a firewall with access restricted to authorized personnel only. Our security controls include software firewalls, encrypted HTTPS (TLS 1.2+), internal data protection compliance communications, and periodic team security training.

Once registered on our site, you can let us know if you no longer wish to receive service-related emails by sending an unsubscribe request. You may also withdraw any consent previously given for the use of your personal data by writing to [email protected].

Grievance Redressal & Governing Law
